Terms and Conditions

1. Purpose and scope

These terms govern the booking of Buteyko Method breathing retraining sessions offered by Respiro Health through respirohealth.eu. We recommend reading them before you book. They are binding from the moment you confirm a booking or make a payment.

2. Business details

In accordance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE):

3. Minors

Sessions are available from age 4. For anyone under 18, booking, payment and acceptance of these terms must be done by a parent or legal guardian. Children under 14 must always be accompanied by a responsible adult, including in online sessions.

We do not collect data from children under 14 without the consent of their legal guardians.

4. Acceptance and booking confirmation

To book, you must submit the booking request form on the website with accurate, complete and up-to-date information. By ticking the acceptance box on the Stripe payment page and completing payment, you expressly accept these terms and become a client of Respiro Health.

Within 24 hours of payment you will receive an email confirming your booking, with a link to these terms. If any detail is incorrect, you can ask for it to be changed or cancel the booking by replying to that email.

5. Description of services

Respiro Health offers:

  • Individual sessions, online or in person.
  • Group sessions or programmes, online or in person.

Online sessions take place on Zoom. You will need a stable internet connection, a camera and a microphone. The link is sent by email before the session. In-person sessions take place at Centro comercial Mar y Sol, Local 5, 11310 Sotogrande, Cádiz.

Sessions are delivered in Spanish, English or French, as agreed when booking. Supporting materials (PDFs, audio or exercise videos) may be sent by email for the client’s personal use.

6. Important health notice

The Buteyko Method is a breathing retraining technique and does not replace medical diagnosis or treatment. The instructor is not a doctor and does not diagnose illness.

  • Do not change or stop any medication (for example, asthma inhalers) without consulting your doctor.
  • Before starting, tell us about any relevant health condition (pregnancy, cardiovascular disease, epilepsy, diabetes, kidney problems or others) so we can adapt the exercises or advise you to check with your doctor first.
  • If you feel unwell during an exercise, stop and tell the instructor.

Results depend on each person’s consistent practice and cannot be guaranteed.

7. Prices and taxes

Current prices are always published on the Prices page of respirohealth.eu. They may change at any time, but the price that applies is the one in force when your booking is confirmed.

Prices are shown in euros and include any applicable VAT. Later price changes or promotions do not entitle you to a refund of the difference.

Session packages expire 6 months from purchase and are non-refundable once the first session has been used, except as provided in the withdrawal section.

8. Payment

Payment is made by card through Stripe. Once your appointment is confirmed as available, we will email you a secure payment link. Your booking is guaranteed once payment is complete.

Respiro Health does not store your card details: payment is processed by Stripe using its own security systems.

9. Cancellations and rescheduling

  • You may reschedule or cancel an appointment free of charge by giving at least 24 hours’ notice to info@respirohealth.eu.
  • If you cancel with less notice or do not attend, the session will be considered delivered and will not be refunded.
  • If you arrive late, the session will end at the scheduled time.
  • If Respiro Health has to cancel a session, we will offer you a new date or a full refund, as you prefer.
  • In online sessions, if the connection fails for reasons attributable to Respiro Health, the lost time will be made up on another date.

10. Code of conduct

Respiro Health may refuse access to a session to anyone who records without permission, shares the Zoom link with others, or behaves in a way that disrupts the session, especially in group sessions.

11. Right of withdrawal

If you are a consumer and book at a distance (via the website, email or phone), you have 14 calendar days from the booking to withdraw without giving any reason, under articles 102 et seq. of the Spanish General Law for the Protection of Consumers and Users (TRLGDCU).

  • Session within the 14 days: if you book a session that takes place before the 14 days end, you are expressly asking for the service to begin within that period. If you then withdraw, you will pay the proportional part of the service already provided (art. 108 TRLGDCU).
  • Fully provided service: you will lose the right of withdrawal once the service has been fully provided, provided you have given your express consent and acknowledged that you lose this right (art. 103.a TRLGDCU). You will be asked for this confirmation on the payment page.
  • How to withdraw: email info@respirohealth.eu with your name, the session or programme booked and the date. You may use the form in the Annex, but it is not mandatory.
  • Refund: we will refund the amount due within 14 calendar days, using the same payment method.

This policy is separate from the cancellation policy in section 9, which applies after the withdrawal period.

12. Liability

Respiro Health provides its services with the utmost professional care. It will not be liable for:

  • Interruptions to online sessions caused by internet, Zoom or client equipment failures.
  • Force majeure or causes beyond its control.
  • The consequences of not following the instructor’s guidance, not disclosing relevant health conditions, or changing medical treatment without supervision.
  • Problems arising from incorrect contact details provided by the client.

Nothing in these terms limits the rights that the law grants to consumers.

13. Ending the relationship

There is no minimum commitment: you may stop booking sessions whenever you wish. Respiro Health may cancel future services if the client provides false information or breaches these terms, refunding any sessions paid for and not delivered.

14. Data protection

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD):

  • Data controller: Yovanka Grueso (Respiro Health), info@respirohealth.eu.
  • Purpose: managing your bookings, payments and sessions, and communicating with you.
  • Legal basis: performance of the contract. Health information you share so we can adapt the sessions is processed only with your explicit consent (art. 9.2.a GDPR), which you may withdraw at any time.
  • Recipients: we do not share your data, except where required by law and with the providers needed to deliver the service (Stripe for payments, Zoom for online sessions, and the website’s hosting and email provider).
  • Retention: for as long as the relationship lasts and, afterwards, for the legally required periods (for example, tax obligations).
  • Your rights: access, rectification, erasure, objection, restriction and portability, by writing to info@respirohealth.eu. You may file a complaint with the Spanish Data Protection Agency (aepd.es).

15. Confidentiality

All personal and health information you share during the sessions is confidential and will not be disclosed to third parties without your consent, except where required by law.

16. Intellectual property

Materials provided by Respiro Health (texts, PDFs, audio, videos and exercises) are protected by intellectual property law. They are licensed for your personal use only. Copying, distributing, publishing them, recording sessions or using them for commercial purposes without prior written permission is prohibited.

17. Dispute resolution

For any complaint, please write to us first at info@respirohealth.eu and we will look for a solution. You may also contact the EU’s alternative consumer dispute resolution bodies: consumer-redress.ec.europa.eu/dispute-resolution-bodies

18. Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, the courts of your place of residence will have jurisdiction.

These terms are also available in Spanish. In case of discrepancy, the Spanish version shall prevail.
